These Terms and Conditions govern the access to, use of, and purchases made through the website https://horek.cl.

By accessing, browsing, or purchasing from this website, the user declares that they have read, understood, and accepted these Terms and Conditions, together with our Privacy Policy and any other policies published on this website.
1. Use of the Website
The user agrees to use this website only for lawful purposes and in accordance with applicable Chilean law.
The following is prohibited:
- using the website for fraudulent or unlawful purposes;
- interfering or attempting to interfere with the operation of the website;
- impersonating another person;
- providing false, inaccurate, or outdated information when making a purchase.
HOREK FOODSERVICE may restrict or suspend access to the website if improper use is detected.
2. Product and Pricing Information
HOREK FOODSERVICE seeks to ensure that the information published on the website, including products, formats, weights, units, availability, prices, and commercial terms, is clear and up to date. However, unintentional errors in typing, photography, description, stock, or updates may occur.
All prices published on the website are expressed in Chilean pesos (CLP) and include applicable taxes, unless expressly stated otherwise.
The total cost of the purchase, including shipping where applicable, will be informed to the consumer before the payment process is completed, in accordance with the E-Commerce Regulation.
Product availability is subject to stock. If a purchased product is out of stock, HOREK FOODSERVICE will inform the customer as soon as possible and, as appropriate, offer replacement alternatives, rescheduling, a credit note, or a refund. Chilean consumer regulations require the express disclosure of stock unavailability.
3. Purchase Process
In order to purchase on the website, the user must follow the procedure indicated on the platform and provide complete and accurate information.
The mere issuance of a purchase order does not imply automatic acceptance of the transaction. The sale shall be deemed completed once HOREK FOODSERVICE confirms the purchase by email or another appropriate means, sending the consumer written confirmation of the terms of the transaction. In distance contracts, such confirmation is mandatory, and if it is not sent, the withdrawal period may be extended to 90 days.
HOREK FOODSERVICE reserves the right to reject or cancel orders in the event of:
- lack of stock;
- evident errors in price or description;
- inability to validate payment;
- reasonable suspicion of fraud or misuse of the website;
- incomplete or inconsistent customer information.
In the event of cancellation due to availability, validation, or operational error, any amounts paid will be refunded according to the payment method used.
4. Payment Methods
Purchases may be paid using the payment methods enabled on the website at the time of the transaction, which may include, among others: [CREDIT CARDS / DEBIT CARDS / BANK TRANSFER / KHIPU / MERCADO PAGO / WEBPAY / OTHERS].
Payment processing may be carried out by specialized third-party platforms. HOREK FOODSERVICE does not store or directly access all of the user’s financial data, except for the information necessary for the commercial and tax management of the sale.
5. Shipping and Delivery
HOREK FOODSERVICE will inform customers in advance and in a visible manner of the delivery coverage areas, shipping costs, estimated delivery times, and any other applicable conditions. Chilean regulations require the disclosure of territorial coverage, shipping charges, and delivery times.
The delivery times provided are estimates and may vary due to logistical reasons, force majeure, unforeseen events, weather conditions, road contingencies, recipient absence, or other circumstances beyond the company’s control.
It is the customer’s responsibility to provide a correct, complete delivery address and reasonable conditions for receipt.
In the case of perishable products or products sensitive to cold-chain conditions, the customer must inspect the goods upon receipt and immediately report any visible issue.
6. Right of Withdrawal
In Chile, consumers have the right to withdraw from purchases made through electronic means within 10 days from receipt of the product, unless the provider expressly informs that it does not adhere to this right, in accordance with applicable law. The provider must expressly state whether or not the right of withdrawal applies.
HOREK FOODSERVICE expressly informs that it does not adhere to the right of withdrawal with respect to purchases made through this website, without prejudice to the other rights granted by Chilean Consumer Law.
7. Exchanges, Returns, and Legal Warranty
If a product presents faults, defects, shipping-related damage, or does not correspond to what was purchased, the customer may contact HOREK FOODSERVICE within the legal term or within the term set out in the applicable commercial policy.
The company will evaluate each case and may offer, as appropriate:
- replacement of the product;
- exchange for an equivalent product;
- refund of the purchase price;
- credit note;
- another reasonable commercial solution.
The foregoing is without prejudice to the consumer’s rights under Law No. 19,496 on the Protection of Consumer Rights, including the legal warranty where applicable. The Pro-Consumer Law extended the legal warranty period to 6 months for defective or unsuitable products.
8. Promotions and Offers
Promotions, discounts, and offers published on the website shall be valid for the period indicated or while stocks last. The essential conditions, restrictions, and validity period of each promotion shall be informed.
9. Intellectual Property
All content available on this website, including texts, designs, logos, photographs, images, graphics, software, and distinctive elements, is the property of HOREK FOODSERVICE or its respective owners and is protected by applicable law.
Its reproduction, distribution, modification, public communication, or commercial use is prohibited without prior written authorization.
10. Protection of Personal Data
The processing of the user’s personal data shall be carried out in accordance with applicable Chilean law and the Privacy Policy published on the website. Currently, Law No. 19,628 remains in force, and Law No. 21,719 establishes a new framework with deferred entry into force until December 2026.
11. Liability
HOREK FOODSERVICE does not guarantee that the website will be available uninterruptedly or free of errors, viruses, or technical failures.
Under no circumstances shall it be liable for damages arising from:
- improper use of the website by the user;
- connection failures, internet issues, or third-party systems;
- force majeure or unforeseen events;
- acts attributable to the customer or third parties unrelated to the company.
Nothing in these Terms shall limit non-waivable consumer rights established under Chilean law.
12. Amendments
HOREK FOODSERVICE may amend these Terms and Conditions at any time. Such amendments shall become effective upon publication on the website.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile.
Any dispute shall be subject to Chilean law and the competent courts of Chile, without prejudice to the consumer’s right to seek recourse before the relevant authorities.
